S.C. Narang vs. State (NCT of Delhi) and Ors. (22.04.2025 – SC)
S.C. Narang vs. State (NCT of Delhi) and Ors. (22.04.2025 – SC)
SC/0685/2025: 2025 INSC 688
The Supreme Court of India addressed whether S.C. Narang, as Chairman of the Managing Committee of Maxfort School, could be held liable under Section 75 of the Juvenile Justice Act for an alleged sexual assault on a child by a classmate. The court found that Section 75 requires actual charge or control over the child, which Narang, as Chairman, did not have. The court concluded that moral responsibility does not equate to legal liability under this section. Consequently, the orders of the Special Court and High Court were set aside, and the appeal was allowed, with no impact on the ongoing case against other accused parties.
