Legislative Council U.P. Lucknow and Ors. vs. Sushil Kumar and Ors. (16.10.2025 – SC)
Legislative Council U.P. Lucknow and Ors. vs. Sushil Kumar and Ors. (16.10.2025 – SC)
SC/1436/2025:
The Supreme Court of India addressed the issue of whether the High Court was justified in directing a CBI inquiry into the recruitment process for various posts under the Secretariat of the Legislative Council, Uttar Pradesh, based on allegations of unfairness and favoritism. The parties involved were the Legislative Council U.P. Lucknow and others versus Sushil Kumar and others. The Court found that the High Court’s direction for a CBI inquiry was based on assumptions and lacked the necessary prima facie evidence to justify such an investigation. The Supreme Court set aside the High Court’s orders dated 18.09.2023 and 03.10.2023, which had directed the CBI inquiry and the registration of the case as a suo motu PIL, and remanded the matter back to the High Court for consideration on its merits. The Court emphasized that CBI investigations should not be ordered routinely and must be reserved for exceptional cases.
