Manish Yadav vs. State of Uttar Pradesh and Ors. (22.01.2025 – SC)
MANU/SC/0149/2025: 2025 INSC 151

The Supreme Court of India addressed the appeal by Manish Yadav against the State of Uttar Pradesh, challenging the summoning order for trial under various sections of the Indian Penal Code and the SC/ST Act. The core issue was whether the appellant induced the complainant into a physical relationship under a false promise of marriage. The Court found that the relationship was consensual and not based on a false promise, as the complainant’s own statements did not support the prosecution’s theory. Additionally, there was no evidence of caste-based abuse. Citing precedents like Uday v. State of Karnataka and Deepak Gulati v. State of Haryana, the Court quashed the summoning order and all related proceedings, allowing the appeal.
